Terms of Service
Effective date: July 2026
These Terms explain the rules for using BuiltFastCo, including our software platform and our website build services. Please read them carefully. We’ve written them in plain English and kept them as short as we reasonably can.
1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and BuiltFastCo ("BuiltFastCo," "we," "us"), operated by BuiltFastCo LLC. By creating an account, starting a free trial, purchasing a website build, or otherwise using our services, you agree to these Terms. If you are using the services on behalf of a business, you confirm you are authorized to bind that business.
2. What we provide
BuiltFastCo provides two related offerings:
- The platform: a subscription-based software platform for service businesses, including tools for leads, contacts, scheduling, quotes, invoicing, payments, messaging, and related features.
- Website build services: design and build of a professional website, offered either bundled with a platform subscription or as a one-time standalone build, as described below.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the services. You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Free trial
New self-serve platform subscriptions begin with a 14-day free trial. A valid payment method is required to start the trial; nothing is charged at signup. Unless you cancel before the trial ends, your saved payment method is charged automatically on the day the trial ends at the then-current rate for the plan and billing period (monthly or annual) you selected, and your subscription begins and auto-renews as described below. We send a reminder email before the trial ends, and you can cancel at any time before then, at no charge, from Settings → Subscription or by contacting us. The free trial applies to new self-serve subscriptions only; website-build offers are billed as disclosed at purchase. We may modify or discontinue trial offers at any time and may decline a trial for accounts that have previously subscribed or trialed.
5. Subscriptions, billing, and auto-renewal
Paid plans are billed in advance on a recurring basis (monthly or annually, depending on the plan you choose). Unless you cancel, subscriptions automatically renew at the then-current rate for the same billing period. Payments are processed by our payment processor, Stripe; by subscribing you also agree to Stripe’s applicable terms.
You authorize us to charge your payment method for all fees when due. Fees are stated exclusive of taxes, which we may add where required. We may change plan pricing on a going-forward basis with at least 30 days’ notice before your next renewal date (or such greater period as required by applicable law).
6. Website build offers
We currently offer three ways to get a professional website. On every path, the website we build becomes yours outright once your build is paid in full, and you are free to use the live site in the meantime. Owning your website and receiving a downloadable copy of its source files are two separate things: while we host your site for you (which requires an active Website Care Plan, our hosting, maintenance, and support subscription), we keep a copy of the source files, and we deliver that copy to you when you move to self-hosting and your build has been paid in full and cleared. Releasing your files is always free once that condition is met; it is never a second charge for a website you have already paid for. Self-hosting is always available.
- Website only (builds from $5,000 to $10,000+ depending on scope, quoted before work begins): We design and build a custom website that becomes yours outright once your build is paid in full; you are free to use the live site in the meantime. Because this path does not include hosting with us, we deliver your website source files to you once your build payment has been received and cleared (which can take a few business days), after which you may host it wherever you like. This path does not include a platform subscription or Care Plan, and platform features are not included unless you separately subscribe.
- Website + Care Plan (discounted builds from $3,000 depending on scope): the same build at a reduced upfront price when paired with a qualifying (Standard or Premium) Website Care Plan with a 12-month minimum term that starts when your site launches. With the Basic Care Plan there is no build discount and no minimum term, so the build is charged at the full Website-only price; because we host your site on any Care Plan, we still hold a copy of your source files while we host it, but on Basic releasing those files is always free, and you receive them on request whenever you move to self-hosting, once your build payment has cleared. On the discounted (Standard or Premium) path, your website becomes yours outright once your build is paid in full, and you are free to use the live site in the meantime. While we host it and hold a copy of your source files during the 12-month term, cancelling the Care Plan early is always allowed and never deletes your site: it stays live through the end of your paid period, then goes offline, and there is no cancellation charge. To take your source files and self-host, you can either finish the 12-month term, after which your files are yours to request at no extra cost, or choose to buy out early by paying the still-unearned part of your build discount, prorated by the months remaining and billed to you by invoice (never charged to a card on file). In every case we release your files only after payment has cleared.
- Complete package (Website + Care Plan + platform plan): the same scope-based build pricing as the Website + Care Plan path, plus a BuiltFastCo platform subscription at a percentage discount off the monthly plan price for as long as the website, Care Plan, and platform plan are all active. The discount requires 12-month minimum terms on both the Care Plan and the platform plan, and does not stack with other discounts (the greater single discount applies). The platform plan’s 12-month minimum is a condition of the discount, not a payment lock: you can cancel the platform plan at any time with no cancellation charge, and the only consequence of cancelling before the 12 months are up is that the platform plan discount ends going forward. The discount you already received is never clawed back, and your website build discount is handled separately (see Cancellation and refunds). Platform-connected features (such as booking, quoting, and payments) function while your platform subscription is active; if that subscription ends, those connected services stop, and the website itself remains yours.
Discounted pricing on any path requires 12-month minimum terms on its recurring components; no discounted offer is available month-to-month. On a discounted build we host your site and hold a copy of your source files during the term; you receive those files to self-host either when the 12-month term is complete or, if you prefer, sooner through an optional early buyout, as described under Cancellation and refunds below. On a full-price build or a Basic Care Plan there is no minimum term and no buyout: we still hold a copy of your source files while we host your site, and we release them to you for free once you move to self-hosting and your build has been paid in full and cleared. After a minimum term ends, the subscription continues month-to-month at the then-current rate unless you cancel, and you may cancel at any time after the minimum term.
Build timeline: we aim to get your website live within 30 days of receiving the materials, content, and approvals we need from you. That is a target we work to, not a guarantee, and it depends in part on how quickly those come back to us. If a build is running behind, we tell you and keep you updated until it is live. A late launch does not by itself entitle you to a refund; what is and is not refundable is set out under Cancellation and refunds below, which also covers what happens if we are unable to deliver your build.
7. Website build payments, delivery, and disputes
This section applies to payments for a website build (and any early file-release buyout), which are paid to and settled by BuiltFastCo directly. The person or business named as the purchaser in your order is authorized to make, and is responsible for, these payments; if you sign or pay on behalf of a business, you confirm you are authorized to bind it. An authenticated card or bank payment you complete for a build fee or buyout is your affirmative authorization of that charge, and where your bank applies 3-D Secure or Strong Customer Authentication, completing that authentication is your affirmative authorization. You acknowledge that your electronic signature on the order, your acceptance of these Terms, the IP address and timestamp we capture when you accept, and your passcode-authenticated portal session together evidence your authorization of the charge and your acceptance of the deliverable.
A website build and its source files are a high-value digital good that cannot be meaningfully returned once delivered. We therefore deliver your downloadable source files only after your payment has been received and has cleared and settled, not at the moment a payment first shows as submitted, authorized, or succeeded. Clearing can take several business days, and for larger builds we may require an added settlement buffer or payment by bank transfer before we release files. Once we have released your source files to you following cleared payment, that delivery is final and is not reversible, and delivered, accepted digital goods are not returnable (this does not affect the refund terms under Cancellation and refunds below, which govern what happens before delivery, including if we are unable to deliver your build).
You agree not to initiate a card chargeback or payment dispute for a build fee or buyout whose source files we have delivered to you and that you have accepted; if any issue arises, you agree to contact us first so we can resolve it, which is also the fastest path to a fix. You acknowledge and consent that, if a chargeback is filed, we may submit as dispute evidence your signed order, your acceptance record, the captured IP address and timestamps, your passcode-authenticated portal activity, and our delivery and download logs, and that these records evidence your authorization and your receipt of the deliverable. Nothing in this section limits any right you have that cannot be waived under applicable law or card-network rules.
8. Cancellation and refunds
You may cancel at any time. How you cancel depends on which subscription you are cancelling. You can cancel your platform subscription yourself, at any time, from Settings → Subscription → Manage billing, which opens our payment processor’s billing portal, or by contacting us. Website Care Plans are cancelled by our team on request: email us at support@builtfastco.com and we cancel the plan for you and confirm it in writing. There is no self-service cancel button for a Website Care Plan today. In both cases cancellation takes effect at the end of your current billing period, and you retain access until then. Cancelling is always permitted and is never treated as a breach; we do not charge a cancellation fee, nothing is charged to a card on file because you cancelled, and cancelling never deletes your website. Except where required by law, or as described in this section, fees already paid are non-refundable, including for discounted website builds, which reflect a reduced build price in exchange for 12-month minimum terms on their recurring components. For a website build specifically: the deposit that starts your build is non-refundable once we begin work on your build, and we begin work as soon as your deposit clears. That applies to a build you decide not to go ahead with. It is not a limit on what we may choose to refund: we may refund you at our discretion in any situation, and any amount you prepay above the required deposit may be refunded at our discretion before your build is delivered. If we are unable to deliver your build, we will not simply keep what you paid. We will either refund the amounts you paid for work we have not delivered or complete your build, and we will tell you which one we are applying. If we are refunding you, you can take that amount as credit toward other work with us instead, if you prefer; we will not apply credit unless you choose it. Credit is an alternative to a refund, not an alternative to a build we are completing. Your build is complete when it materially matches the scope set out in the quote and order you accept. If we have delivered your build and you believe it is not right, that is handled as a revision against that agreed scope, not as a refund and not as credit: tell us what does not match and we will correct it. That is a different situation from a build we have not delivered at all, which stays on the refund or completion path described above. Anything you ask for that is outside the agreed scope is new work rather than a revision, and we quote it for you separately. The refund terms that apply to your build are the ones stated in the quote and order you accept. If you cancel a qualifying Care Plan that qualified for a discounted build before its 12-month minimum term is complete, your site stays live through the end of your paid period and then goes offline, and we keep your source files safe rather than delete them. To take those files and self-host, you can either complete the 12-month term, after which your files are yours to request at no extra cost, or choose to buy out early by paying the still-unearned part of your build discount, prorated by the months remaining and sent to you as an invoice. If instead you are on a Basic Care Plan or bought a full-price website, there is no minimum term and no buyout: whenever you move to self-hosting we release your source files to you for free, once your build payment has cleared. On every path, we release your source files only after payment has cleared. If you cancel the platform plan on a Complete package before its 12-month minimum term is complete, the only consequence is that the platform plan discount ends going forward: there is no cancellation charge and no clawback of the discount you already received. Your website build discount is tied to your Care Plan, not your platform plan, so cancelling the platform plan never affects it; the build-discount buyout described above only applies if you cancel the qualifying Care Plan early. We honor our obligations under applicable automatic-renewal and consumer-protection laws, and where required by law we will provide refunds notwithstanding this section. 9. Your content and responsibilities
You retain ownership of the content, business data, and customer information you provide ("Customer Content"). You grant us a limited license to host, process, and use Customer Content as needed to operate and improve the services and to provide support. You are responsible for your Customer Content, for having the rights and any necessary consents to provide it, and for your own compliance with laws that apply to your business and to the people you communicate with (including marketing, SMS/email consent, and privacy laws).
10. Acceptable use
You agree not to misuse the services. You will not: break the law or infringe others’ rights; send unlawful, deceptive, or unsolicited messages; upload malware; attempt to gain unauthorized access to the services or other accounts; reverse engineer or resell the services except as permitted; or use the services in a way that harms BuiltFastCo or other users. You also may not use the services for any business or transaction that is prohibited or restricted by Stripe, card-network rules, applicable law, or our policies. We may suspend or limit accounts, or disable payment features, that violate this section or that create elevated chargeback, fraud, legal, or reputational risk.
11. Sensitive and regulated data
The platform is a general-purpose business tool and is not designed or certified for highly sensitive or regulated data. Unless we agree otherwise in writing, you may not upload or process protected health information (HIPAA), Social Security or government ID numbers, bank or card credentials (beyond the tokenized payment data Stripe handles for ordinary payments), background-check or criminal-history data, biometric data, precise medical records, or other specially regulated data. BuiltFastCo is not a HIPAA business associate, and the platform is not HIPAA-compliant unless we sign a separate written agreement. You are responsible for ensuring your use of the platform complies with the laws that apply to your business.
12. Intellectual property
The BuiltFastCo platform, software, and brand are owned by us and our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the services during your subscription. Except for websites we build and deliver to you under the website build offers described above, these Terms do not transfer ownership of any of our software, templates, or platform components to you.
13. Third-party services
The services rely on third parties such as Stripe (payments), our hosting and infrastructure providers, and email/SMS providers. We are not responsible for third-party services, and your use of them may be subject to their own terms. Optional integrations (for example, QuickBooks) require your own active account with that provider.
14. Support and availability
We provide support on a commercially reasonable, best-efforts basis through the channels we designate. Unless we agree otherwise in writing, we do not promise specific support hours, response or resolution times, a guaranteed uptime percentage, or uninterrupted, error-free availability, and these Terms do not create a service-level agreement. The service may be unavailable or degraded due to maintenance, updates, outages, third-party provider failures (such as payments, hosting, database, email, or SMS), your own connectivity, or other causes beyond our reasonable control.
15. Disclaimers
The services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that they will produce any particular business result.
16. Limitation of liability
To the fullest extent permitted by law, BuiltFastCo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the services will not exceed the amounts you paid to us for the services in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
17. Indemnification
You agree to defend and indemnify BuiltFastCo against claims, damages, and costs (including reasonable legal fees) arising from your Customer Content, your use of the services, your violation of these Terms, or your violation of applicable law or the rights of others.
18. Changes to the services or these terms
We are an early-stage product and may add, change, or discontinue features. We may also update these Terms; if we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use after changes take effect means you accept the updated Terms.
19. Termination
You may stop using the services at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the services in a way that creates risk or legal exposure. Upon termination, your right to use the services ends; sections that by their nature should survive (such as payment obligations, IP, disclaimers, limitation of liability, and indemnification) will survive.
20. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Subject to any binding arbitration provision described below, you agree to the exclusive jurisdiction of the state and federal courts located in [PLACEHOLDER: county], Texas for any dispute not subject to arbitration. Mandatory consumer-protection laws of your place of residence may still apply and are not waived.
The platform terms you accept when you create an account include a binding arbitration provision and a class-action waiver that affect how disputes are resolved.
